State can't prosecute Indians on private lands within pueblos, court says

Link to Santa Fe New Mexican

This is a story I thought many of you out of state shareholders may want to read. The Jacona Grant is not within Indian Territory. This is what makes the Grant so appealing to new homes and buisness.

This picture is part of Jacona Plaza one of the oldest homes in US. I refer to this Plaza as Don Ignacio Plaza.

Santa Fe New Mexican doing story on land grants and Jacona Grant is featured.

The last couple of days I’ve been busy with a reporter and photographer for the Santa Fe New Mexican. With all the controversy on the Atrisco Grant, (Westland Development Corporation) at least one interested organization has been inquiring about our property. In the next couple of weeks a story about WDC and Jacona Grant will be in the Santa Fe New Mexican. Apparently they are interested in learning more. So be on the lookout for the story.

Our little venture into the wilds of the Jacona Grant brought some disturbing items. An apparent stolen 1-ton Ford 4X4 dumped and torched on the grant. Tuesday I thought it may have been an accident and on Thursday after the photographer and I got a closer look, the person that drove it to the grant drove in to hide the vehicle or goofing around got the $30,000 truck big time stuck. This $30,000 possible stolen truck was a utility 1-ton with a burned up compressor. I’m guessing that Mr. Goofball got it so stuck, tried to back out, overheated and ignited. Mr. Goofball didn’t want anyone to find the owner and removed the VIN, all the salvageable tools and bugged out. I have a lot of speculation and no answers. Someone was out of a high dollar truck and the insurance company probably paid the owner either way.

So many Piñón trees have died from the combination of bores and drought, again I can only speculate that in some areas a least 50% or more of the Piñón trees have died. Don’t get to upset; this has been a trend the past few years in northern NM. Fire is a major danger on the Grant.

I had another confrontation with Goofball #2 while giving the tour to the SFNM photographer. He claimed to be Roybal and gave his fathers name as an owner and his fathers name is not on the shareholders list. If anyone is on the Jacona Grant and claims to be an owner’s son he should at least know his dad’s name. If this so called owners son should have enough pride in owning this property he shouldn’t be trashing our past with disrespect of the land and other owners. After a few choice words and some hand gestures on his part. We parted. It’s people like him that encourage returning to Texas. It’s an embarrassment to be with a professional guest and have to deal with drunks claiming to be Roybal. I can only apologize for Goofballs like this idiot. The last time I saw him he got stuck in Pojoaque River sand, again he was in a place he should not have been. Maybe he’ll learn the same lesson Goofball #1 learned.

Lessons for all that enter the grant, be prepared for vehicle damage, getting stuck in sand and paint removal by dead trees. Ask permission from Pojoaque Pueblo for access to Grant. When someone questions your rights on grant don’t get mad, just explain whom you represent. Know the shareholders name. Properly introduce yourself like a gentleman, shake hands. If the person gets mad because someone asks, they are probably trespassing. If their getting drunk on grant land I believe they need to leave, members or not, they need to set an example. Many of the roads on the Grant are dangerous for tipping over, even at slow speeds are possible. If kids are not careful they can get killed at 5 miles an hour. I really don’t relish the thought of finding some kid on an ATV dead on the Grant. If your kids are caught on the Grant with an ATV they might be asked to leave. If they’re disrespectful they will be told to leave. If they are good Grant citizens they will be told to stay on the main road. If they get hurt, at least we’ll be able to find them. Anyone trashing the grass will be told to leave. These rules are what the Grant members want and I feel the need to bring this up on this blog.

I had business on the Grant and I ripped the muffler out from under my jeep. The grants roads are at worst, jeep trails and some are worse and at best a county dirt road. If you’re not familiar with driving on roads this bad you need to stay out. Members are always welcome but should be respectful; I have no tolerance for stupid.

SunCal Companies makes offer on Westland Development

SunCal Companies makes offer on Westland Development
Los Angeles Business from bizjournals - June 2, 2006

Westland Development Co. says it most likely won't hold a June 8 shareholder vote on the sale of the company because a new suitor has emerged and is offering a higher price to its shareholders.
SunCal Companies of Irvine has offered to purchase Westland's 794,927 outstanding shares for a price of $280 per share or approximately $222 million, according to a news release issued by Westland Thursday.

Sedora Holdings of Las Vegas was slated to buy the land for $212 million or $266.23 per share and a vote was scheduled for next Thursday, June 8, on that bid. Sedora also committed to spend $1 million per year for the next 100 years to fund an Atrisco Heritage Center. SunCal is offering benefits "nearly identical" to the deal with Sedora, according to Westland's release.
As it now stands, the June 8 election will most likely involve only the vote by shareholders for three of Westland's directors.
SunCal is a family-owned company founded in the 1930s and is one of California's largest privately held developers of master-planned communities. Its projects include Serrano Heights in Orange, the Tesoro Del Valle in Santa Clarita, and Oxnard's in Mandalay Bay.
Westland considers the offer by SunCal to be a "superior proposal" to Sedora's offer and is giving Sedora until Monday, June 5, to negotiate a counter offer, the news release states.
SunCal has promised to reimburse Westland for up to $3 million of its expenses. It has offered to distribute to Westland's shareholders, or a charitable trust, all of Westland's future oil and gas revenues from current leases and 20 percent of revenues from future mineral leases after the completion of the sale/merger.
In addition, SunCal has elevated a termination fee to $10 million. It is a fee that Westland would pay if SunCal's proposed merger, once agreed upon, is terminated. Earlier this year, Westland paid a $5 million termination settlement to an earlier bidder, ANM Holdings of Delaware, who dropped out of the bidding war for the land when Sedora made its offer. Sedora put up the $5 million in order to negotiate its deal with Westland.
Last October, ANM proposed paying $203 million or $255 per share for the Albuquerque, NM area company. Sedora appeared in February with its offer. ANM withdrew in March and Sedora appeared all but certain to get a shareholder's vote. The offer by SunCal was made on Wednesday, May 31.
A two-thirds vote of Westland's 6,000 shareholders is required for any sale to take place.

I hope this will help the shareholders of the Jacona Land Grant come up with ideas for our property in Santa Fe County.
